GENERAL TERMS & CONDITIONS

These General Terms and Conditions exclusively govern the contractual relationship between Yachting Exclusive GmbH (operating under the brand Dobner Yachting) as the intermediary of nautical services and the client. Yachting Exclusive GmbH acts solely as an intermediary for all services, in the name and on behalf of the respective service provider (e.g., charter providers, skippers, sailing schools, delivery companies, accessory suppliers). A direct contractual relationship regarding the execution of the service exists solely between the client and the respective provider.

1. SCOPE
These terms apply to all nautical services mediated by Dobner Yachting, including but not limited to yacht charter, sailing school, skipper and crew services, yacht deliveries, accessories, and other nautical services.

2. CONCLUSION OF CONTRACT
The contract for the execution of the respective service is concluded solely between the client and the service provider. Yachting Exclusive GmbH is only responsible for the proper mediation and acts in the name and on behalf of the service provider. The terms and conditions of the respective provider apply and will be made available to the client in due time.

3. PAYMENT TERMS
Payment is made according to the conditions of the respective service provider. Yachting Exclusive GmbH is authorized to receive payments on behalf and for the account of the service provider.

4. LIABILITY
Yachting Exclusive GmbH is not liable for the proper execution of the mediated service, but only for its proper mediation. Liability only exists in cases of intent or gross negligence within the scope of the mediation activity.

5. COMPLAINTS
Any defects or claims arising from the execution of the mediated service must be addressed directly to the service provider. Yachting Exclusive GmbH supports the client in communication upon request but assumes no liability for the fulfillment of claims.

6. PLACE OF JURISDICTION AND APPLICABLE LAW
Austrian law shall apply exclusively to the mediation relationship. The place of jurisdiction for disputes arising from the mediation is the competent court at the registered office of Yachting Exclusive GmbH. For disputes from the respective main contract, the jurisdiction and legal clauses of the service provider apply.
